What is the name of your state? OHIO

divorce decree states that ncp has children for spring break. This year school spring break runs from April 18 - April 21 (4 days) with school to resume on the 22nd, the problem is he made vacation plans in FL. for April 17 (departure date on which kids will have to be released early from a day of classes) with a return on April 27th (with the kids missing an extra 4 days of classes) and he is saying he doesn't care, they are going! not to mention he is imposing on my Easter holiday because I was informed I would not be able to get them as they would be in FL. Can he cause the kids to miss this many days of classes? They are driving and already have a child so it isn't like they are going to be out any money on air fare or hotel reservations...what am I suppose to do?

Is it the end of the world if they get to take this vacation with their dad? After all,you get to be them most of the time, it sounds. My folks took us out of school a few days around spring or winter break every other year, and those trips are a very important part of my memories of them. My dad became terminally ill when my sis was 12, so thank goodness she got those times together with him before that happened.

We did not suffer academically by those few extra days out of school. WE all went on to have successful carreers and stable home environments. So what is the big harm if they miss a half day, thereby getting an extra weekend with their dad, and then a few days after break? And doesn't spring break frequently overlap Easter? Not always, and not all school districts, but in our area, Easter was always during Spring Break, so wouldn't Easter generally be presumed to be celebrated with whomever the spring break parent is? Or is that addressed seperately?

I read the post to infere that the mother is the NCP, and it is her turn to have the kids over spring break and that the cp(dad) has made plan that interfere with her outlined visitation....
My understanding is that the CP is NOT to interfere with the NCP s visitation by scheduling events during that time , unless they confere and AGREE to it in advance, Emergency/serious illness...
Definately I am not an attorney, but the CP could possibly be in contempt. I wonder if NCP should send letter to CP with the grievance and document it for future use??

my children have a dad that has spring break this year which runs four days according to the school calendar...he wants to take them out a day early and keep them 5 extra days and keep them on MY Easter holiday (which is addressed seperately, I tried to have that changed to read whomever has the children for spring break has them for Easter but he wanted none of it because it will not benefit him next year), not to mention if the shoe were on the other foot there would be no way in the world this would happen...I was just wondering if anyone else has found themselves to be in this situation and what they found to do about it....he can have his time in the summer as far as I am concerned because part of the divorce stipulation he HAD to have in there states that the children MUST maintain an A/B average and now he wants to take them out of school at his convenience...

sorry for the misinterpretation.

I have the two weeks prior to the Fourth of July and the two weeks after the Fourth of July with an addition two weeks to be agreed upon by mutual consent, as my court outlined visitation( my request, due to a family tradition of 4th of July In Pa(we live in FL)... HOWEVER I am Ordered to have the children available for their fathers Bday which is the 5th... I am screwed unless I take it to court or the Ex agrees(not likely to decline his BDAY) Attorney told me that it is I would likly NOT get the judge to agree to the modificate to exclude the Exs Bday and not to waste the money trying.. I cannot afford to fly, and the drive from PA is not possible for me to follow the tradition of the 4th up north AND have them back in time for the Bday..
Let me know how you make out with the EASTER you probably would have a chance of modification

Still a little confused. But I'll read this as additional NCP time. You don't say anything about the children not keeping the gpa up.

Since this is a pre-paid planned vacation, I would let them go ahead. Make up your time at a later date. If the children haven't had excessive absences or low grades, it shouldn't hurt them. They can get their assignments ahead of time and work on it during vacation. I did this up until I was in 8th grade. (I stayed on the honor roll.)

I'm taking my stepson out an additional week to coincide with his sister's vacation, and I know it won't hurt him. This way he gets a chance to work on his assignments on his "down time", spend time with his sister and visit his mom's side of the family all in one trip. (No one has complained to me.) Plus, you'll be showing how flexible you can be for parent/child time. The favor may be returned some day.
