My husband has legal custody of his 10 year old daughter, him and his ex divorced, when she was 14 months old. All these years, she has visited her mom like scheduled, but now she does not want to go visit her, she said she does not feel safe, and it does not feel like home. We asked her if anything has happened at her last visitation which was September 24 2000. She said no, I just want to stay home and be with you and Daddy. She said she thinks of me as her mom and her real mom her step mom. I want to know can we get in legal trouble by not forcing her to go visit her mom? We told her that it is her decision to go that her Daddy and I want her to make her own discission. What ever makes her happy is all we want. Please help me if you can. Thanks. Vkmn2

The mother can take you to court if you do not do everything possible to make the visitation happen. There have been some cases where a judge will order a change of custody so as to help the relationship with the NCP.. That is rare but you need to be aware of it.. The child really needs to either explain her problem to the mother or tell you why she does not want to visit before you can decide anything..

Thank you for your reply, We have tried to get her to just spend the day with her mother, she still claims nothing is wrong, and she just wants to stay home. Her mother wanted to come up here to see her and she still said no. She didnt even want to go down for her birthday, and doesnt want to go for christmas. I thank you very much for your help. Vkmn2

Well, if your husband and his ex is on speaking terms then the next step might be to take her out to dinner.. just the 3 of them and talk about it.. or just get in the same room together and talk.. at least that way the mother will hear it straight from her.. it will give you some protection in the event of legal action.
