Visa for Wife
I am a U.S. citizen , born in the U.S.
No, we did not fill out an Affidavit of support. We filled out form OF-156.
The Visa was denied under seccion 214 b which states an appicant must supply proof of ties to their home which will ensure their returning after the Visit. And they must show they have favorable economic situation at home, In Mexico.
My wife works for Pemex , the Mexican oil company, which is a very good job here in Mexico. She had her pay records with her to prove it. And she also had Statements showing the amount of money I have In CD`s, and Mutual Funds. I am retired, and have received a Lump sum retirement Pay.
My wife was issued Visas before we were married using her Pay records from her job with Pemex. So It seems to me that the proof of a favorable economic situation should be very well satisfied.
As for the proof that she will return after the visit. I believe the fact that We cancelled an application for resident papers for her to live in the U.S. In February 2000 and moved back to her home town in Mexico should be proof that she does not want to remain in the U.S. We cancelled the papers because she did not like living in the U.S and she missed her family very much. This decision to cancel the papers was not one we took lightly because It cost me several thousand dollors and lots of time and effert, to apply for her and her son.
The Lady doing the interview for the Visa had this information on the Computer records for my wife and we also had a letter showing this. The Lady asked my wife where her husbands legal home of residence is my wife told her San Antonio. This ended the interview. The Lady would not look at any of my wifes papers or listen to anything else my wife had to say.
Seems to me there should be some way to appeal a decision on the spot. One person , The lady doing the interview, should not have the power to deny just because she is in a bad mood. Unfortunatly my wife did not get the Ladies name.
It should not be this difficult to get a Visitors Visa for the spouse of a U.S citizen! We only want to visit my relatives in San Antonio at Christmas time. Believe it or not , some Mexicans really dont want to live in the Great United States.
