Visits during I-130 process

Hi,

I am hoping someone qualified can answer me, as my regular attourney is very sick and unable to advise me at this time.

I am Canadian and my wife is from the United States. We met on the internet in May 1999.

How often and how long can I visit my wife in the U.S. during the I-130 process, if any? Some websites I see say no, some seem to indicate yes. Our attourney has advised that I can visit her during the process, but for no more than 5 months at a time, and I'm not allowed to work while in the U.S.

I guess I'm just looking for someone to second that motion, and back that information up, as our attourney has become very ill, and can't advise us at this time.

I have a chance to visit her starting August 31, 2000, but I'm not sure if I would be jeopardizing anything with our I-130 by doing so.

Entrance to the US is determind by the INS officer at the POE. They have incrediable on the spot powers to either let you enter or deny you access.

Legally you can visit during the I130 but some people have been denied for various reasons. My advice is to ensure you have plenty of proof that you intend to return to Canada. Also be honest and when they ask if you have a g/f or visiting someone tell them exactly what is happening. It is a leading question as they already know about your application.

If you have a bank statement showing money and proving that you do not have to work then all the better as they will be interested in knowing how you intend to support yourself..

5 month is about right and is a good time..
