What is the name of your state? California
I have a court order right now that I’m getting modified but for the time being I want to do what the law says. My ex lives in GA and it is his year for Xmas vacation. In our decree it says that the person to move away pays transportation. That would be me (he cheated, we divorced, I moved home) It is getting close to Oct which for money reasons I should buy a plane ticket. He has not made any phone calls since his son has been home from summer vacation. So I have no idea when to send son. Do I have to contact him? If he does not contact me until the last minute do I still have to pay and send my son? If I write him stating that I need a date for trip by Oct 15th or I will take it as a ok that son does not need to go for xmas, and he doesn’t contact until the last minute (which is what he usually does) will I still be in contempt if I don’t pay for tickets or send son?
Don’t want to look bad in front of judge but really want ex to step up and pay some attention (hate the out of sight out of mind thing).

why don't you be the bigger person and just call him today, ask what dates he would prefer because you would like to buy the ticket.

if he hems and haws research ticket prices, print them up, and tell him that is your top dollar if he waits he pays the difference. in this case even if it does end up in court I can see a judge ruling in his favor, when waiting until the last minute can and does double the price of a ticket.

Because I've been holding his hand for the last five years and doing it all. Do you know what I hear every other night of the week from my son. Why dosen't dad call me, Why dosen't dad return my calls, Why didn't dad send what he promised.
I'm out of reponses. I would like dad to wake up. :confused:

well if you don't have the child available to him then you are in contempt unless your co states that if he doesn't notify you by a certain date he forfiets his visitation (which I don't think it does or you wouldn't be asking this question)

so your options are call him and get it set up or pay more when he decides to set it up.

you could file for some sort of modification to get this handle more precisely but that won't got through before this christmas.

Thank you that is what I needed to know. I do have it in motion to fix the decree. It will be a lot more to the point. Thanks to this website I have learned a lot of things I didn't know back then. I don't want to be in contempt of court while trying to get my decree fixed. I will suck it up again and call him like I always do and take care of this. Thanks for the advice. :o
