My H1-B visa has been pending at INS for 7 months now. My friends want me to visit them in the US to be with them for Thanksgiving for a couple weeks.
Am I allowed to visit the US for a couple weeks while my H1-B is pending, using the Visa Waiver Program?
I am an Australian citizen.

If this is not allowed, what are the penalties?
Also, if it is not allowed, is there any other way I can travel to the US to visit for a couple weeks?

This is a tough question as it can come down to the actual office at the Port of Entry. One officer at one POE will let you in, another may not.

Consult the USEmbassy in Aus.. and when you fly to the US, take lots of evidence that you intend to return to Aus and make sure you tell them everything at the POE.
