What is the name of your state? nh

:confused: I just started a pt job,( the owners are from india )now i never filled out a w2 form at this job. but he asked me what i was claiming and that he needs to tell his accountant. O.K. NOW THIS WEEK WHEN I WAS GETTING PAID HE TOLD ME HE HAS TO HOLD 5 HOURS ( FOR TAXES).WHAT IS UP WITH THAT?
SHOULD'NT I HAVE SOME KIND OF PROOF FOR MY SELF AS FAR AS TAX RECORDS GO? I THINK I'M BEING SCREWED HERE, AND IT IS FOR HIS BENIFIT ONLY. ANY ADVISE IS GREAT THANKS

Tell your employer that you INSIST on completing a W2 form (required). Also, that you will NOT accept a deduction from YOUR pay so that he (the employer) can pay his taxes.
And if needed, be prepared to quit if needed. Finally, call the IRS and report this employer for his illegal practices.

Um, that's a W-4 form, not a W-2. And it isn't required; if not completed, the employer must withhold at Single-0.

Having said that, however, it doesn't sound like this employer has a clue about payroll taxes. The amount of withholding has no relationship to hours worked. My "free advice" is to find another job.

You're correct and I wasn't. Sorry about that. Note to self: Do NOT try to answer quickly while heading out the door!!

I agree 100%. However, I think it is likely that the employer may know what he is doing. The 'key' was in the original post: "the owners are from India"!! :eek:

As in, he knows what he is doing is wrong, but he doesn't care and if he can get it by an uninformed employee, all the better? :rolleyes:

I once worked for a guy, not from India, but from Pakistan, which used to be part of India.

He admitted freely that he didn't know employment laws in the US and was hiring me to "keep him legal". However, every time I told him something he didn't want to hear, which would involve either him doing something he didn't want to do or not doing something he did want to do, he'd convince himself that that particular law didn't apply to him. No matter how often I, or our corporate attorney, told him it did.

It is also true, however, that he honestly wanted to do what was best for his employees. It's just that he wanted to do what HE thought was best for his employees and not what the law said was best. Or required. Or prohibited.

I don't think it was cultural though, at least not all of it. Some of it was just him.
