California What is the name of your state? My employer handed out our W2's but I did not get one. After checking to see if mine was set aside, I told the human resource manager that I did not receive my W2. She informed me that I had to submit a written request, so I did. The day I submitted my request, I was given a "duplicate request form" which stated that I will have to agree to have 25.00 dollars withdrawn from my check for a processing fee. When confronted, the swine, I mean, manager told me that was my only option and there was nothing more that she could do. What are my rights?

Just for curiosity's sake, what did they say happened to the original? Mailed it? You moved? Sorry for being cynical, but I've been in payroll for over 25 years, and I've heard all the stories.

According to the IRS website regarding W2s:

If you misplaced your W-2, contact your employer and be prepared with the information listed above. Your employer can replace the lost form with a “reissued statement.” Be aware that your employer is allowed to charge you a fee for providing you with a new W-2.


Now I assume your employer is going to say they sent out every W2 and obviously you lost yours. It is their word against yours here.

I think that if the employer had MAILED out the W-2's, the OP would have said MAILED, instead of 'handed out'. It would appear that the forms were distributed by hand, presumably at work... at a small employer. If that is the case, the issue of the form being 'lost' is not relevant. Simply, accept the posters statement at face value and quit assuming other 'issues'.

I was just trying to determine if, since his W-2 was not handed to him directly, did they mail it instead. He did not state whether or not he was at work the day they handed them out.

Pearbear.... did they mail the W2 to you or was it 'handed out' to the employees?? :D

Well, it appears obvious from his post that his was not handed to him . Just because it was handed out to other employees, seeing that he did not get his that way, doesn't mean they didn't mail his singly for some unexplained reason. I have noticed that he has not responded to my query as to what they say they did with it when (if) he asked them :D
