Hello. I filed claim on a Temp Agency for waiting time penalties. The law has changed regarding the end of an assignment not meaning termination. BUT, in my case I was completely terminated by Temp Agency. No end of assignment. They said I lied in my application. They also said that they will not look for future jobs for me to do. They took 14 days to pay me. I am worried that the Deputy Commissioner will throw our claim as soon as they see the words Temp Agency. Should I write letter like this one and take it to be attached to my claim for I turned recently. Should I write the main people of Temp Agency about this so they might just want to avoid conference and pay? Do you think Temp Agency will lie and say that it was just end of assignment which it wasn't?

We have no way of knowing what either the DLSE or the temp agency will do.

I very much doubt that the DLSE will ignore your claim because it was from a temp agency. However, it is ALWAYS the opt of the DLSE whether to apply waiting time penalties or not - they are not guaranteed under any circumstances. You may or may not receive them, but it won't be determined by whether the employer was a temp agency or not.
