My warranty deed states that I an subject to building and use restriction and easements of record. The building and use restrictions speak of location of fences on the property and the heighth, bldg sq. footage and maintenance of the easements. Does this bind me in any way to any homeowners association that may be formed? There is not an association at this time. How would I know if I were legally bound to join an association? How would it be worded on by warranty deed?

No, unless there is a Declaration in the master development that requires all owners to be a member of the HOA (when formed) and this was not picked up by the title company. Or the State or County requires a HOA.
