What is the name of your state (only U.S. law) ? mi
My hot water heater had a slow leak. It did not do any damage to my unit, my neighbor claims it damages her baseboards. She wants me to pay the $210 it cost to replace them. I am fine with that but she also wants me to pay an $850 emergency plumber bill. First she knew two weeks before she called the plumber it was my heater and at that time the maintance guy for the condo drained it for me, so Im not sure why it was an emergency two weeks later? Do I have to pay that also?What is the name of your state (only U.S. law)?

It was YOUR hot water heater. You are responsible for maintaining your own equipment so that it does not cause damage to any other of the neighboring units by its malfunction.

I would tend to agree that if the water heater leak had been discovered two weeks prior, and it was drained to prevent any further leaking, that after two weeks, the "emergency" status would no longer apply. The damage had already been done, and unless there was danger of further damage occurring in the immediate future, it wouldn't be an emergency anymore.

Perhaps the neighbor was just so frustrated and upset about the whole situation, and in their mind, calling it an "emergency" was they only way to get someone out there to fix the water heater right away. But that doesn't mean you should have to pay the premium cost of the service.

When you were presented with a copy of the invoice/bill for the plumbing work, what exactly did it say was done? How much of the charges were considered necessary for "emergency" service?

**A: and when did you know about the problem? When did you inspect the heater last and how old is it? What is the detailed billing to explain the $850 and did this cost include a new heater?
