What is the name of your state?TEXAS

Can someone sue the CDC, or Red Cross, or Carter Blood for discrimination that doesn't allow gay men to give blood? This is such an old ammendment put into place back in the 70's and late 80's when there was a HIV epidemic and panic. They screen the blood twice now. Also, we can give kidneys and livers all day! Its not fair. When I went to give blood, on 9-11, i was denied. Thats wrong. What can be done?

Are you serious? Is this really true? Have you done any research to see GLAAD's take on this issue?

Sorry, I have no advice to post, but I was just so taken aback that I had to respond to your thread.

Hey, heterosexuals carry HIV and sexual diseases too, but they can give blood. Also, its still statisically true, MORE heterosexuals carry HIV/AIDS than homosexuals to this day, read the CDC bullitins. All I was saying is it makes no sense why we as gay men can't give blood in time of need--or any other time. Its completely not warranted. And as for the "epedemic"...I meant to say, "hysteria". But that was 20-30 years ago. You now have ***** Eye for the Straight Guy (Thank God cause mullets were getting out of hand), Ellen taking over the Emmy's, and people are simply "growing up" finally. Its time for a change. I am sorry, but if you think my blood is riskier than yours as a straight man, you're dead wrong. And how inappropriate to be rude on an ADVICE forum.

It is evident you have a great vocabulary but unfortunately cannot implement the social skills to go along with it. As I was saying, and will continue to post, GAYS, LESBIANS, AND BISEXUALS ARE DENIED THE RIGHT TO GIVE BLOOD IF SEXUALLY ACTIVE OR EVER HAS BEEN WITH MALE-TO-MALE PARTNERS. So, I was asking, has anyone ever sued for this? Can someone file a class action lawsuit for discrimination for this? These are LEGAL questions. They involve policy issues yes. But who died and made you forum baby sitter?

Lots of people can't give blood for various reasons. There are very good reasons to restrict blood donations. I can't donate blood but not for your reason, I also can't sit in the row of seats by the exit because I use a cane.
So what?

And, according to the CDC and the Food and Drug Administration AND the U.S. Surpreme Court, so are people who have recently travelled to Portugal and France based on the POSSIABILITY they may have come in contact with mad cow disease, as well as anyone who has contracted West Nile disease, anyone who spent a total of six months in Britain between 1980 and 1996 and those with specific diseases such as Hemophelia. And if you have a problem with those conditions also, then I suggest you speak with Dr. Jay Epstein.

I'm sure there has been some idiot who has tried. The problem with that however, is that you must first get permission from the Federal Government to SUE the Federal Government.

Hmmmm...If I was bleeding to death and no "straight" guy's blood was available would I risk using a "gay" guy's blood ? Something to think about.... :confused:

Think about this. There is nothing remotely to do with "Gay" or not in this thread that the POSTER himself didn't whine about.

The REAL fact is, he is diseased .... Plain and simple. He had a blood disease that precludes him from giving blood.

The fact that he is gay (and I use that term ONLY to keep mary happy) is secondary.

They have ways of replacing fluids, and most blood banks have supplies of "O" blood.
Chris has Hep B, you don't want his blood!
