What is the name of your state (only U.S. law)? Missouri is where I live. My 7 year old daughters biological father has been in and out of prison since she was 4 months old and my husband has been her only father figure since she was 2. I want to know if and how my husband can adopt her. She wants to be adopted.

What she wants legally does not matter. This is between you and dad (not the legal stranger she calls dad).

you'll need dad's permission, your husband would have to consent.

has dad been legally established at dad? support ordered? visitation schedule?

and if dad happens to bring it up in court that youre allowing your daughter to call your husband dad( when he is not) you could find yourself stripped of custody for engaging in parental alienation. judges frown heavily on that kind of behavior

Why would you ask a seven year old child to make such a life changing decision?

Do you allow her to choose whether or not she goes to school?

If she was diagnosed with acute appendicitis, would you allow her to choose not to have surgery?

Do you allow her to choose whether or not to brsuh her teeth? Do homework? Chores?

A seven year cannot possibly understand the legal and emotional implications of adoption.

What have you told her about her father?

Danny...this is one of those times when the "rote" answer doesn't apply. There is no way that a judge is going to give custody to someone who has been in and out of prison since the child was 4 months old, and who hasn't seen the child at all for 5 years.
