I was informed that I was to be promoted from Asst. Manager to Manager within 3 months, this was in January. Now, I am told that I will not be promoted because of my weight. I have been the top salesman on the floor for the last six months or more! Can they get away with this? I was also humiliated in front of other employees and customers when the District Mgr. referred to my weight as "a 16 gallon keg being carried around". HELP!

Saul, the Americans with Disability Act may protect you. Read the section on ADA under employment on FreAdvice.com.

And try to lose weight. It will save your life and jumpstart your career, laws aside.

You should certainly ask an employment law attorney near you, but to my latest understanding of the law, such discrimination is not unlawful. You can find an attorney at attorneypages.
