What is the name of your state (only U.S. law)? CA

I tried to send $500 through western union online service. They denied my transfer based on a "Business Decision" but debited my bank account $500 anyway through ACH.

They said it would be refunded within 10 business days + what my bank takes to process it.

Its been 20 business days now and my bank wrote me an affidavit they haven't received the funds, though western union insists that my bank has it already.

What can I do?

Contact Western Union while at your bank. Verify the account they returned the funds to.

Work with them to get the issue resolved.

not that easy, western union can't even give me a bank to bank tracking number.

calling them just yields their philippine call center

If only it were that easy, it wasn't a credit card transaction but a check/ACH withdrawl.

the bank says they aren't even obliged to refund me.

Western Union branch locations claim to be independant franchises of the main company.

I'm just wondering if this has to go to litigation and what I should try to claim for it and how to start.

Independent franchises still maintain relationships with customer service and corporate offices.

There is no point in going to litigation. They told you the money was returned to your account. You are saying it was not. What needs to be done is tracking toe money from acct#123456789 and making sure it ended up in acct# 987654321.

You are jumping to litigation over what is probably an innocent clerical error.

What are you doing right now to try an resolve this????? Have you gone in with your bank statements showing the intitail withdrawal, the western union paperwork showing the denied transfer and the bank statement showing the money was never returned to you bank acct?

Here we are a few weeks later; I've sent certified mail, faxes, talked to the highest supervisors i could reach by phone (who happened to be philippinos).

I've found that their call center workers are trained to lie because each one I speak to tells me it will be another 10 business days.

Do I file a police complaint or a small claims?

That is relevant...how?

They're probably trained to tell a customer "10 business days" every time a new ticket is created (and every call likely creates a new ticket) - because that's standard practice.

I'm obviously not seeing the great conspiracy you are, sorry.

Have you actually gone to WU in person, as was previously suggested?

I went to a location in my area and they tell me they are completely seperate from the online service that robbed me.

Their call center hangs up on me, sure I was a bit vulgar, but they can't help me either.

I've sent faxes and certified mail to their corporate address regarding this matter but received nothing.

My non-related tax attorney says I have to take them to small claims court, am I able to claim time/damages?

The person who answers the phone for you at the call center ISN'T the person responsible for the error. What gives you the right to be rude, vulgar or inappropriate with them?

You still are not doing this right.

It will cost you way more than $500 to get an attorney to do this.
I doubt you'll be successful finding an atty to help you and with the attitude that you've shown here, I'm not going to hold your hand anymore either.

And in small claims court, I'm fairly certain all you'll get--if you prevail--are actual damages.

And as an aside: I once tipped $2000 for a pizza. The clerk erroneously entered my $2.00 tip as $2000. I worked politely and closely with and from my bank and the vendor and it took about two weeks to resolve. Attitude matters as well.

So heres where I'm at:

Western Union says the money was refunded late February but for security purposes they can't provide me with a receipt or transaction number for that, are unable to fax me anything, and generally can't do anything but tell me they don't have the money anymore.

My bank says they haven't seen it and are asking for a receipt or transaction number.

What is there left to do?
