I have a confusing mess on my hands. I have 2 small children and I have sole custody. I also have a restraining order on their father which lives 3 blocks away, he moved there to try and control us. I did have a stalking order against him but lost the case because I did not mention everything on the order, which I was told later by the Judge that in Oregon you have to do this. I am my own attorney in this mess. Then he tried to get me for contempt of visitation which he lost big time. My girls do not call him nor answer the phone because they don't want to, he is abusive towards them. I am going to court on Mondy May23th for the hearing on the restraining order he asked for it. I am taking along with me, a sealed envelope from my childrens Dr. which in it has the last abuse, my 9 year old received a cuncussion from her father, she is also depressed has anxiety attacks when he calls, and was referd to a behavioral specialist for depressed children. This has got so bad that both girls ages 8 and 9 wet the bed, have nightmares and often sleep with me. There grades have dropped slightly since the abuse stated again, in Dec. Dec. he was drinking and driving with the children and ran his car into the garage door. Jan. He kicked the 9 year old in the face, he says it was an accident, she says on purpose, Feb. he hit my daughter on the side of the head, and in April pushed her against a metal pole. I also have child services coming into court with our files, and a sealed envelope from the Police department that took our statements about the cucusion. My children have not talked to their father since April and they have not visited him either. One visitation child serves stepped in and told him to skip his weekend, they wanted to see if the DA would prosecute him for abuse, but it came back as the abuse was undecided. Last weekend they were suppose to go to his house and both threw a fit, yelling and screaming at me and refusing to go, so they didnt. So he threatened me with his attorney, all hearsay, his attorney never said anything to me. The girls say that if I "force" them to visit themn I am not protecting them, and thats true. Why should I force two little girls to visit a man that abuses them both physically and mentally with his provanities towards them, that is not in their best interest. The restraining order did not change the visitation, but he is not allowed on their school grounds or near me. He still drives up and down the street. Then mothers day he went to my parents house to question them on me, but my parents said they will not answer any questions that he has, and he was informed that I was on my way there, he left so fast he didnt even say goodbye. This was his first visit there since the divorce. My parents do not like him. Then on Tuesday while I was planning on going to the childrens school to et lunch with them like I do every week, his mother was there. So I did not go inside, I was trying to avoid a confrentation with the witch. I picked up my children like usual and the counselor there informed me that his mother came there and ate lunch with the youngest but the oldest told her to get out, so she did.His mother gave the youngest money, she likes to bribe the children. My youngest said that she didnt want to see her grandmother but did take the money. She stated that nobody can bye her love, not her father or his mother. They have not talked to his mother since the abuse allegation either . They both blame her also because she raised this man and she has "never" done anything to protect them from him. She addicted to pain medication, anti-depressents and drinks alcohol, her husband, the girls fathers step-father is an alcoholic, and I do not want me kids around them, again its not in the childrens best interest. I have also file a motion for modification of his visitation, I want supervised only. He has mental problems and has for may years. He brings single men to his house with the children there and takes them to strange mens homes and will not allow the girls to know who these people are or even sit next to him while he is visiting, nor hear any conversations tht he has with anyone while the girls are present. This scares me because he has had 2 friends of his go to prison for child molestation in the past 7 years. My question, do you think I have a chance in court for the restraining order, or not?
