What is the name of your state?New York.My boyfriend and my future sister-in-law are siblings.My boyfriends' mom passed away just over a year ago.She didn't leave a will.At the time of her death,my boyfriends' mom was married.The man she was married to IS NOT the biological father of the children(the children are NOT minors-they are twins,between the ages of 38-40).My future sister-in-law somehow got the idea that she was the executor of the estate.As I understand it,that isn't true;excutors must be appointed
by the person making out the will.Is this correct? Can ANYONE be the executor,or does it HAVE to be a familly member?

As I understand it,my future sister-in-law has now told the lawyer,'My brother
should not be the executor of the estate.He has a learning disability."

F.Y.I-yes,my boyfriend DOES have a learning disabitlity-HeS' dsyslectic,NOT STUPID!
Can anyone anwser to this situation?

Since dyslexics have problems reading, it would not be wise to have him serve as executor. Choose a probate attorney who has experience being executor or do it yourself and hire an attorney only for consultation during the process.
