I'm in Georgia. My wife filed for a divorce in March. I was served and I was required to leave the premises immediately.

We attempted mediation in June. There was no resolution.

In June, I suggested to my attorney we move forward to a judges decision instead of waisting money and time with anymore mediation.
Now six months later, I still do not have a court date.

Production and interrogatories have been exchanged by both parties.

I was told by my attorney that Sep is the earliest but probably by the end of the year.

Can you tell me what my attorney should have done, should be doing now? I do not wish to go back and forth with my attorney with e-mails and phone calls since this does nothing but add to my tab.

What are the steps my attorney should have taken by now to get a court date scheduled?

Why is there such delaying or stalling?

Thank you. What is the name of your state (only U.S. law)?

Why do you believe there is stalling? I can easily tell you this -- six months is a SHORT period of time. Doing discovery and interrogatories is NOT delaying. It is making sure that you are completely aware of ANY and ALL assets and debts that exist.

Thank you but you didn't answer my questions.

Mine was 10 months - and that was a VERY quick divorce - considering that we had to go through mediation and a custody evaluation. 6 months plus a few more to schedule the hearing doesn't sound at all out of line.
