I am a law enforcement officer. Last year I was being investigated by our intern affairs unit. The investigation started November 5, 2007 and On January 15, 2008 During thiis two month period I was placed in a desk position still wearing my uniform, caring my gun and driving my marked patrol vehicle. On this date I was taken into an empty office where a Captain and Lt. were sitting , they took my gun / gunbelt and vehicle and gave me a written directive to appear at a physocoloyist office within an hour. I complied.
Once at this physocologisht office I refused to sign any authorization allowing anyone to give or discuss any of my conversations with his Dr. I had been seeing the EAP Physocologist and my own pyscrisict for approx 8 to10 prior to this and currently still see them due to the stress of my employeement.
This Dr. gave my department all information about what i said in my confindental meeting with him.. (specific words were used by my immediate supervisors /administrors) My personal information not associated with my job was discussed and put into writting for the sheriff's office.
Do I have a HIPPA violation against the doctor, and how long do I have to sue over a HIPPA violation. The depart. continues to use the results again me not taking into consideration anything my weekly therophist had written to the department.
