What can be done to end this situaiton before my husband ends up the hospital?

My husband and I live in a sponsored rented coop.

The apartment above us was purchased several months ago. The new tenants have been doing major renovations. The problem is that have been working seven days a week almost round the clock for 15 weeks.

My husband is home and situation has finally gotten to a point where all the noise has affected his health.

These tenants are in clear violation of the rules of the coop. The rules state that the renovations are done with board approval between the hours of 8:00AM to 5:00PM weekdays and work on Saturday would require board approval. These tenants work when ever they feel.

My husband spoke to the super. He would just get answers like today is the last day of the work. He contacted the management company several times in writing. The responsed once a month ago that we work would be completed that week and that the renovations were good for the coop.

My husband has been forced for leave the apartment on daily bases for hours at time. He would come back home and find the work still going on after 5:00PM. I even was forced to go out of town a few weekends ago because he was feeling so stressed. I have even bought him noise reduction head phones and a white noise machine.

My husband has diabetes and when he went to see his doctor for a regular visit he found out his glucose was elevated. He told the doctor what was going on and his doctor told him he felt his glucose had risen because of the stress.

He has been feeling so ill that he finally went to see a psychologist.

I finally had no choice but to speak to lawyer and he wrote a letter demanding that management stop the renovations and that they send the documents executed by the Unit Owner and Management re the renovation.

I had written two letters to the management office myself and had even called the police.

The property manager called me and just said he would forward the letters to the board and I would receive an answer in writing.

I am sure the tenants have received a copy of the letter from my layer. These people are still working and there seems to be no end in sight.

Using all of your evidence, send management your notice to vacate due to the A) no reason needed because you have no lease OR B) the reason to break the lease being your renters right to quiet enjoyment has been breached.

OR you own this condo, in which case I have no idea what else you can do.

Your city can tell you what its noise ords are and if construction , remodeling has a different set of noise ords and every time they are working on the unit at a time of the day that violates the noise ord call the police , and keep calling , sooner or later a officer may show up , if they do they will address it, if they have to repeatedly come out they are likley to do more than warn. Keep track of dates and times of day you call police and include that in written communications with the board.
