Hello,

I recently got a ticket for speeding in San Jose, Ca. The scenario was as follows:

I was at a stop light with a few other cars. Both lanes turned onto another road and I was the lat car in the group. Traveling at the same speed as the other cars we came upon a motorcycle officer and he tried to stop both my car and the car to the left of me. Of course since I was closest i stopped and the other car took off. He stated that I was traveling 55 in a 35, the ticket stated 50 in a 35. There was absolutely no way I would have been traveling that fast because one of the other vehicles in the group was a big bus going slow forcing everyone else to drive slow. What can I do about this? Should I attempt to challenge the ticket in cour by myself or should I hire a traffic lawyer? What key items can I bring up to support my case?

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Well, it seems more of the principle and not the fact you got the ticket. If money is not an issue, may I suggest you get a lawyer and have him help you collect the following: pictures of that place at the time you got the ticket (preferably try same day of the week), i.e.possibility of bus being there again. Call the bus company and ask about their routes there and driving patterns. Be a scientist to prove how the circumstances of the traffic around and in front of you could not possibly allow you to go as fast as the police officer ticketed you for.

Hope this helps.
