What is the name of your state (only U.S. law)? GA

Ok I worked for an employer for a little over a month and he never paid me during that time so I quit. I have been trying to collect money from him since the end of last year to no avail so finally I complained with the DOL but in my state they do not collect.

I sent out of certified letter trying to resolve this matter and got no response, yet I see he received it and he was on FB bragging about this lavish beach trip he was taking his family on. What do I do now?

Do I send an intent to sue to him? If I sue him in small claims court do I sue him personally or his corporation becasue he is incorporated but DBA something else? Can I ask for punitive damages? If I receive a judgement how will I go about gettin my money?

I have every letter and phone records proving I have tried to contact him and resolve this.

File a claim with the federal DOL or a small claims action against the company. To the best of my knowledge, punitive damages are not allowable in small claims.

When you contact him about your pay, what reason does he give for not paying you?

Ok thank you. He does not give a reason he dodges and will not answer emails or anything. His wife handles the administrative tasks so I cc'ed her on the emails and she sent him one back asking him to please handle this for me but he never responds. This was an ongoing problem even when I worked there. Ex employees would come up there mad and ready for fight and acting animalistic because they had not been paid. He is also known for bouncing checks so none of the check cashing centers or walmart money centers will cash a check from him and most banks put a 7 day hold on checks from him.

When I called the federal DOL they refer me to the regional office which is in Atlanta and I have been calling and I've been told that the only thing they can do is make contact with him on the telephone and if they cannot I will have to take it to small claims court.

Do I list the corporation and him personally or just the corporation?

Depending on the type of corporation it is, his personal liability may be limited. File against the corporation, DBA whatever.
