state of nevada. my husband and i are getting a divorce. we have agreed on how property should be split. we plan to do the divorce ourselves with a paralegal to prepare the forms. the house is the problem. my husband is going to keep the house and i will give him 5 years to refinance and buy me out. i would like my name off the title to the home, to avoid any possible liabilities my husband may incur. at the same time i want quarantee that in 5 yrs i will be able to get my money. can i quitclaim the property to him then file a deed of trust and get a promissory note in exchange for my interests in the house. is there anything i might be overlooking? i am trying to keep things as simple as possible. also there is another amount of money he has agreed to repay me for credit cards i paid off on his behalf prior to our marriage, the amount is 15,000 do i need a promissory note for this too or having this written into the divorce papers enough?
