What is the law on employers causing unessasary emotional distress?

Example: An employee has a heart condition. The employer knows this and goes out of the way to cause extreme stress on the employee. When the employee informs the employer that he is having chest pains and is unable to control blood pressure and that his doctor believes that too much stress is causing this, the employers continues to cause extreme stress.

(The stress is emotional, humiliating the employee, not part of accomplishing the day to day job)

Not all states recognize "emotional distress" as a factor that a complaint can be filed upon. Even in the states that do, it would depend ENTIRELY on the EXACT circumstances. An example in a vaccum cannot be commented upon with any validity.

Additionally, if an individual's job or work environment exascerbates an exisiting medical condition, the employer may be liable for a worker's comp claim. That depends on State WC reg's however and the exact circumstances of the situation. Stress claims are difficult to prove.
