My husbands ex called today and wanted my husband to "come and get this boy before i kill him". So we went over there and she said that he was not listening to her and being disrespectful to her and other family members. so he told her that if he took him tonight that he was going to keep him for good and she let him go but called about 30 minutes later and wanted to know when he was going to bring him back now my husband wants to keep him. How long does he have to wait before filing anything for custody?

He could file based on her death threat alone, if he can prove she said it...which isn't always easy to do.

What does the court order state right now in regards to custody/visitation? Are you both in the same county and does that county have jurisdiction?

She has primary custody, they have a shared custody plan, he has them for half of the year. She moved to Ga right after the divorce but she has a PO box in Fl for her " child support".
I was told that since she has not set up residence in GA, then Fl still has jurisdiction. When she called she called the cell phone. Can the son be a witness? He says that he acts up because he wants to live with dad and mom is always bad-mouthing him in front of them. What should we do?
