my girlfriend and i was talking about going down town and doing the paper for her 2 year old son to become my son but we do not know what paper to file or anything but we both still want her to have her rights n me just e the father

Not possible.

You could adopt if Mom AND Dad signed away their rights. Then you'd be a single parent, and Mom would have no rights.

Otherwise, you'd have to be married to Mom and get DAD to sign the paperwork for you to adopt. :cool:

You would need to get married first. And then, most judges will prefer that you are married for at leasta year bfore making such a dramatic change to the child's parentage.

YOU need to realize that, if you and your wife divorce, you will be on the hook for child support. There will be no getting out of that, absent ANOTHER adoption.

MOM needs to realize that if she and you divorce, she may end up the NCP.

This is not a step to take lightly.

Your girlfriend and the child's father BOTH need to relinguish their parental rights so that you can adopt as a single parent. What you want to do cannot be done. Marry her, be married for a period of time to convince the court you are a stable married couple and then get dad to relinguish his rights OR prove that the father's rights should be terminated.

thia child has a father already-and its not mom's current bedwarmer( you). unless you do what the other posters suggested, you cannot be this child's father. you will be a legal stranger with no rights whatsoever.

To put it in a NICER way....the only way you can become the child's legal father is to adopt the child, which is a LOT of paper work and a lot of time.

I have been married to my husband for 7 years, the child has lived with me for 6 years, and I filed to adopt him as a step parent adoption on April 12, 2011, the case just finally got before a Judge on 5/14/12! Over a year to get in front of the Judge....and I had to send my finger prints off to the FBI, and CPS had to investigate me....etc.

It is a long process and it is an expensive process, we spent about 3 grand and that was with the mother never contacting the court, or answering our petitions, or even showing up to court to object and it was STILL 3 grand.

Where is the bio dad in this picture? He would have to be served the paper work even if you did file to adopt, and if he agreed it would go quicker, but still a LONG LONG process, and not an easy sign some stuff type of thing.

You were married. The OP is a boyfriend, and a short term one at that.

And he was told to adopt the child. IN a nicer way? Really? There is nothing un-nice about telling him that adoption would involve his girlfriend relinguishing HER rights as well as the child's father relinguishing HIS rights for this individual to adopt. He is in Ohio. According to the Ohio Supreme Court, I know Ohio law. You are speaking of a stepparent adoption in ANOTHER state. This would NOT be a stepparent adoption because he is NOT a stepparent. But thanks for playing.
