what rights as a father?

What is the name of your state?Ohio
My ex and i have seperated we were never married, from this relationship we have a two yr old son. I filed for residential custody today, myself. :eek: . Before i went to today i thought that i had no legal rights to the child. Now, i have paternity established ,from CSEA, i have his birth cert., and today at that social security office they gave me his real card, since i needed it to file.My question is since i have proved i am the father of this child what visitations am i allowed. At this point the mother wants me to have a notarized statement saying " i will have the child one hour a week, and the entire weekend, every other weekend", which to me is unacceptable. Is this legal, am i entitled more, according to state of ohio? Please respond to this as quickly as you can , each day is one more day my son goes without his father.

P.S. i already agreed to notarized statement and have four copies, all original's, do i abide by her rules or demand more visitation?

How is each day one more day your son goes without his father when in your last post, you said the mother constantly "pawns" your kid off on you? And you only give him back by making her call the police? I guess your custody petition was thrown out and now you're feeling small 'cause you're no longer in charge?

I haven't kept up with your other threads , ( you should keep it together ) , nor will I go back through and read them all.

To answer your Questions :

No , a notarized statement means dittly squat . The orders have to be in the form of a Court order signed by a Judge.

Secondly, If you have had an on going relationship with your child and there are no unusual circumstances , you should be entitled to every other weekend ( maybe 1 day a week ) , every other holiday , fathers day, and 2 -4 weeks in the summer . " normal visitations " .

Why do you feel then need to constantly come on my threads and bash me? Can a father not be a good parent. I have taken care of the child since birth, his mother only wants him now so that she may play games. There was no custody petition. We never married so i have to go to court to establish custody. She has "pawned" him off on me, which i gladly welcome.Since, last Sunday when I made her get the police, which was the first time, she refuses to allow me to see him. That is pretty basic visitations schedule's yes .

With all due respect , you need a Court Ordered Custody/visitation schedule. Even if she agrees outside of Court to a standard visitation schedule, sooner or later she will assert her dominance over you again , and it will have to be brought into court .
 
I have filed

i have filed for residential custody and asked the courts for shared parenting, i just spoke with the ex, and she already is asserting her dominance. So, as of now i must go along with her and wait for the courts?Will the courts allow shared parenting if one parent doesn't want it? She had verbally agreed to it ,now she says she will not allow it, because she doesn't trust me(because i made her get the police)? Is there anything I can do right NOW to lengthen my standard visitation. It will take 10 to 12 weeks for mediation? Do i just wait? Patience is not one of my strong points. Is there anything more that i can do? :confused:

If she had to call the police to get the child, why are you surprized that she won't let you have him now? That is exactly what ANY parent would do if they had to call the police to get the child back. She is most likely being advised not to let you have him again until a judge makes orders. It was a VERY dumb move on your part.

It is unclear here .
Did you have physical Custody of your child since birth ?
What do you mean by the mother Pawning the child off on you ?
Where did the Police come into this , and why did they allow the mother to take the Child?

You need to clarify, if a short , to the Facts , paragraph or two. Not a long drawn out story .

Somehow, you're not getting the point. You have multiple threads, none of which present the entire story. You're expecting us to waste time searching all of your posts to try & put together the situation and what you're asking. Most people simply are not going to bother. Either make it easy for people to help you, or go pay for a lawyer's time.

And you say you couldn't reply on this thread, yet there's your post! Quit screwing around already.
 
i erased the other thread

now the mother and i were never married, we seperated on11/20/04. I have established paternity (CSEA), i have his birth cert, and got his social yesterday, we had agreed to shared parenting, within the last mth, she started leaving the child with me longer and longer, this last wk, she saw him for 23hrs, on day, then dropped him off with me, at 1200 sunday night she came to get him, never called, just started pounding on my bedroom window, i told her no, get the police she did , saying that she only had custody. Is that true? I have filed once before while we were still together, but it was dismissed since we never went to court. I filed for residential custody, and some sort of shared parenting, yesterday,1/20/05. What do i do now? please answer with as much info as you can and i wont post again.

And this is very ignorant on her part .Pounding on a Bedroom window at 12:00 midnight waking up the father , Picking up a sleeping child . Very Immature . I see where the Father gets the mother pawning the child on him.

The Father had/has equal Custody until there's a court Order. She apparently convinced a Police Officer she had Custody, and being the mother helped .

This child is not property .

This is actually incorrect, BL. Since 1998, an unmarried mother in OH automatically has sole custody until and unless a court orders otherwise. She was completely within her rights to insist on having the child returned to her.

Ok , I stand corrected on the Law , but it's still morally wrong ,and Immature to use the DAD that way .
