i live in south carolina and my new husband and i are wanting to move to west virginia to make a better life for our kids and a better job is also there not to mention the schools... my ex husband has rights to see the kids one weekend a month and he doesn't pick them up for that but my ex-in-laws ahve the right to see the kids the first weekend of every month and on christmas eve from 9 am to 9 pm... i agreed for them to see them and it is court ordered but now we want to move and it is 8 hours away they want to try and stop me... it was also in the court papers i was to meet them in modoc which is the city we both live in and now they want me to bring the kids from west virginia to south carolina every 3 months and bring them down on christmas eve... if i do that it will mean 5 kids on the road every 3 months and on christmas eve which means we couldn't spend christmas in west virginia... i have no problem with them seeing them but the distance is a little much to handle and they won't meet us half way or anything... i know i will have to take them back to court but do they stand a chance in what they are asking me to do with the judge or will it go in our behalf... then my ex husband has the one weekend a month deal and he doesn't get them he sees them when they go to his parents house but if he did pick them up on his weekend then he doesn't have to go no further than 40 miles from his house that is also court ordered but he hasn't picked them up since 1997 but still sees them when his parents get them... i agreed to this when we went to court because i was ready to get this over with and his mother said she would pay for the divorce because i couldn't afford it at the time but i had to agree on her terms... my ex only pays $47.00 a week child support for 3 kids and gets to claim the oldest on his taxes again because i agreed to it... i am in desperate need for advise on if i have a chance with them or if they have a better chance at keeping us in south carolina... please someone help me i don't know where else to turn.... desperate here...
