MY DAUGHTER WAS ADOPTED BY MY HUSBAND 3 YEARS AGO. SHE HAD PREVIOUSLY HAD VISITATION WITH HER BIO FATHER AND THEN HE QUIT.MY HUSBAND AND I ARE NOW DIVORCED AND THE BIO FATHER IS BACK IN HER LIFE. HE WANTS HIS RIGHTS BACK AND MY HUSBAND WANTS TO GIVE UP HIS RIGHTS. WHAT DO WE DO?

You go through the same adoption process as the first time. I'm not going to comment about what I think of this scenario....I will suggest to get your daughter some counseling.

I suppose you would have to file an uncontested adoption...again. You would repeat the whole process which you should be familiar with. Legal Father would agree to relinguish rights to the child, and the bio Father would accepts all rights again.

Yes, I overlooked that obstacle of the two of you not being married. Typically, you do have to be married to the person whom is adopting the child. I'm not sure in this case, if that can be overlooked. I suggest you call an attorney in your area and receive a free consultation, you will get your answer and the costs involved if you are able to do this.
