A band on a major record label is unlawfully using my self portrait as the cover of a digital album single being sold on their labels website and on places like amazon, napster, and many other e-commerce websites.

The band had expressed interest in another photograph I had taken but had sold to another agency. I offered them a replacement and sent it to their art directors to consider but never heard back from them. I never implied verbally or in writing that the photograph was gratis, and was never compensated.

It's evident that have two separate cases against them as both the exclusive copyright owner and the model in the photograph, but where to file?

I've lived in California the entire time. The band is from Chicago although was traveling through California on tour where the discussion of the photograph took place in person. When they left the state it moved to email. Now some of the members live in New York.

I'm seeking a lawyer but I want all the advice I can get.

I'm sure your lawyer will know where to file.
Did you stamp the photo that you sent then "SAMPLE". If not then go out and buy such a stamp.
