My wife was out shopping for jeans for a night out on the town and went to a store and was trying on jeans apparently the jeans have a sensor on them the sensor was not properly placed on the jeans and it left her with a cut 7 inches long on her left calve she said she thought that it was the price tag plastic that has scratched her and she couldn't see the sensor just yet and then she felt something on her thigh when she was pulling on the pants and then the sensor fell out of the jeans. The sensor on the jeans is about and inch long and a very sharp point she has a cut on her calve and a cut on her thigh. She told the dressing room attendant who told her to talk to the manager so she went up to the front and talked to the manager. The manager didn't have a first aide kit it took her 15 minutes or so to look to see if she did. The manager did find peroxide and my wife cleaned the cut. It was bleeding and the cut looks like its going to scar. What do we do? The store was neglected to place the sensor on the jeans and now my wife will have the scars on her for forever and the cut is big. The manager and my wife wrote on a piece of paper about the incident and the manager took a picture of the cut. Today my wife called and asked if she could have a copy of the report that was taken by the manager and she said that she would not be able to give her a copy and she would need to to back to the store monday and call their corporate and have them record what happened.
What are our rights and what should we do? Would it be possible to sue?
