Our last hearing the judge said my ex could have additional supervised visitation if her mother and her mother's mother got hair follicle tests within 7 days. I said 3, but the judge said 3 days in not enough time for them to schedule the test, they can have 7 days from today. Now my lawyer is saying that they get 7 days from the day the order was signed, which really gives them 30 days. My ex said last night her grandmother gave her lawyer a hair follicle test that was taken months previous to the hearing, and that her mother went 2 weeks after the court date to get hers, and that visitation would probably start next Monday.

I have two concerns; first the grandmother did not comply with the stipulation of the test; for that matter neither did her mother; second, my ex has been kicked out of her mothers house (going on two weeks), she has no where to live. She said it was because of domestic violence (again)... she also has brand new criminal charges on her, as of last week. She won't pick up the summons because then she knows I can get into her folder and read the charges. (It would then be public record).

Does it make sense that the child should go to a house where she no longer lives and was kicked out of? The police verify she no longer lives there as they tried to deliver the summons and could not; returning it to the courthouse.

Any suggestions.

For hair follicle testing...it doesn't really matter if they took it last month, this month, etc...the reason hair follicle testing is being so widely used is because it covers a greater time span.

If the visit is 'Supervised'...who is the Supervisor? If it's Gma, then the visits can take place @ Gma's whether or not Mom lives there.

actually the judge worded it so that Mom has to be there. Right now her paternal grandparents are supervising, but the maternal grandparents feel they are being supervised and asked for additional visitation at their home. Since there is domestic violence at the home, and drugs, the judge ordered the 'men' not be present, and the grandmother/great grandmother of the child be tested.

It is specified in the new order that Ms. X will have visitation at Mrs. X's house after negative hair follicle tests have been reported to the court. There are no provisions for the grandpartents to have visitation right now.
