oklahoma- my brother lives in a small town with good ole boy law enforcement/judges. he has divorced his wife and was fighting for custody for their child. of course he lost. the last time he took her to court it was because she failed to show up for visitation, their child had been in the hospital for 3 days and he was never told, and she would not share the babies medication with him out of spite. they have all this admitted to on tape. the judge finally handed over temp custody to the father for 8 months. it took 8 months because the mother kept asking for continuances because she would not retain a lawyer. my brothers lawyer proved in court that she repeatedly purjured herself in court at the last hearing, and that she was still purjuring herself during this hearing. they had witnesses that the maternal grandmother leaves the baby in a car when shes in town and that her own children were taken away by dhs because of neglagence, the maternal grandfather has also alegedly molested his own children, admitted to by the mother.(the mother lives with her parents) they have had their water, electric, and phone disconnected because of non payment many times, they live on welfare, steal from wic, she was ordered to pay child support and attorny fees which she never did and was fired from the last 4 out of 5 jobs shes had within the last year. her last lawyer even quit due to her non payment. the fathers lawyer knew they had a solid case as they had witnesses and proof of everything. the mother had nothing, but the fact she was the mother. the mother was awarded custody because she was found better fit because the father was being petty if all he had to complain about was late visitation. it was like he didn't even listen to anything that was said. the entire courtroom/other courtroom employees were in shock after the decision. the judge basically used my neice as a way to punish the mother for showing up late or not showing up for visitation at all. what can be done beside filing an appeal- as this is a repeat pattern. the lawyer has found court case after court case ruled on by this judge where the father never wins even when the mother as admitted she does not want the children and would dump them the first chance she got, she was still awarded custody. please give us some ideas as to what to do next!!
