What to file to stop Ridiculous Security Zone in Hawaii?

So during the president's stay in HI over Christmas, they closed down a large part of Kailua Bay, a ridiculous amount of water and beach, to recreation users.

My question is what needs to filed to prevent this in the future? I was thinking some kind of injunction and/or suing for declaratory judgement that bay must be kept open, just not sure what exactly to file and in to what court...

It is depriving many people access to public beaches and the ocean in that area. Sure, I can understand a security zone but that is too large an area. It is much larger a buffer then they normally have.

Imagine them clearing people within 100 feet, that is pretty reasonable? Now, keep expanding that, it reaches a point where it is ridiculous. What if they made everyone leave their homes withing a 5 miles radius of the president? That is where the question comes in and I want to raise it in a court.

I didn't really post it hear to debate it, I just want to know what I have to file and where to call it into question...

You can file whatever you like until you're blue in the face..but you won't be in court and you won't be asking the "what if".

File a complaint with your congressman; you have no case.

You won't be able to get it changed. But, you can try with your local congressman.

Google TFR for Temporary Flight Restrictions. Piloting groups have been fighting these for years. Wherever the president goes, he is "protected" by a 30 mile no-fly zone. I think they'll let scheduled airlines in and out.

The POTUS vacationed on Marthas Vinyard this summer, and essentially closed both airports on the island for a week. when Bush was in office, his trips to Maine would shut down another slew of small airports.

AOPA (Aircraft Owners and Pilots Association) has been fighting this all along. They have a huge war chest, along with plenty of staff lawyers. They haven't been able to stop it, so I doubt you can.

But knock yourself out anyway.

Sure, go to your local Federal District Court and file for an injunction.

Most of the time they let the scheduled service, but if he is actualy AT THE AIRPORT it can cause a real mess (remember Clinton's haircut incident...that was even before 9-11).

I guess you have never been or filed in court, they will have to at least show up or file a motion to dismiss to prevent it from going to court in the first place...I have learned that a big part of "the law" is forcing your opponent to put forth effort, a lot of times that will drive a settlement...and the more effort the better your compromise...hell, maybe if they just think about how many people they are screwing they will just change it...

Did you look at the map of the area they blocked off? It is an entire bay...for ten days. That is the only time that a lot of people have vacation and can enjoy the beach, surfing, kiting, etc... A lot of people were upset with this, especially since it was last minute with no advance notice. That area rents vacation homes for thousands of dollars a night, imagine planning your dream vacation only to have no access to beach and ocean because of that zone...I can see some kind of restricted area, but they blocked off like the entire bay! Or maybe just ban motorized craft in that area.

It's a good thing for you that Rule 11 is normally only used against lawyers.
