I AM CURRENTLY PURCHASING A HOME IN TEXAS, & THE PERSON SELLING ME THE HOME (INDEPENDANT SELLER), HAS LEFT ME IN LIMBO. FIRST OFF, I AM LIABLE FOR (ACCORDING TO OUR CONTRACT) MONTHLY INSTALLMENTS OF $624. BUT THE FIRST 5 MOS. HE CHARGED $676 WITH NO EXPLANANTION AS TO WHY. WHEN QUESTIONED REGARDING THIS MATTER, HIS RESPONSE WAS "OH, I WAS LOOKING AT THE WRONG TAX BOOK" AND DID NOT CREDIT OUR ACCT. ALSO, ACCORDING TO OUR CONTRACT, MY INSTALLMENTS ARE DUE NO LATER THAN THE 15TH OF EVERY MO. AFTERWARDS, THERE IS A LATE FEE OF $25. IN AUGUST, (8TH, TO BE PRECISE)HE COMMENCED SENDING ME LATE NOTICES. HE THEN, EVERY MOS. SINCE, HAS PERFORMED THE SAME ROUTINE: EVERY MOS. PRIOR TO THE 15TH, HE HAS SINCE SENT ME A LATE NOTICE PRIOR TO THE 15TH. ACCORDING TO MY RECEIPTS, I AM A MONTH AHEAD. ONE THING ALSO: ACCORDING TO THE COUNTY CLERKS OFFICE HERE, HE ISN'T LISTED AS THE HOMEOWNER. AFTER SOME INVESTIGATING OF MY OWN, I ALSO DISCOVERED THAT THIS PERSON HAD HIS REAL ESTATE LISCENCE PULLED & HE WAS ALSO CHARGED WITH FORGERY ON REAL ESTATE DOCUMENTS. PLEASE ASSIST.

Your contract probably says the payments are due on the 1st, late fee assessed if not received by the 15th. If your payment is not received by the first, it is late so he is within his rights to send you late notices. Easy to fix, start paying by the first.

As for the overpayments, ask for a refund.

As for ownership, I really have no idea why he would'nt be listed as the owner other than he may have purchased the home just before selling it to you and the county is backed up. Other possibility may be he has a contract for deed with the owner. I'm not sure if this is legal but perhaps you want to ask him about it.
