I filed suit pro se in June 2012; the defendants filed a Rule 12 motion right away: and I filed my opposition. Had the hearing today on the Motion to Dismiss, and I prevailed. What happens next? I'm almost positive that the defendants will be submitting the response within 14 days after the recommendation is issued. What will happen now? Scheduling conference?

Is your case filed in District court? Sounds like the next step is the judge will require some type of Case Management Conference so he can see your plans for Discovery. I don't know what type of response the Defendants can submit if you prevailed on a motion to dismiss. I suppose they could appeal the decision if they had reasonable grounds to get the motion overturned.

Perhaps the Defendants will require a Deposition with you. Or perhaps your case is solid enough to file for Summary Judgement. Let us know more about what your case is all about--it sounds interesting. :)
