:confused::confused:What is the name of your state (only U.S. law)?Georgia I know someone who was written a citation when caught shoplifting at Walmart. Not long after, he was sent a letter from a law firm saying that they were filing a statutory civil suit, (representing Walmart) against him because of the situation with the shoplifting charge. They were requesting he pay 425.00 in damages. Is this to settle out of court or is he being sued just because he shoplifted? What exactly is going on with this? Thanks to anyone willing to enlighten me on what this is all about!!!! :)What is the name of your state (only U.S. law)?

he is being sued because he shoplifted. He is being sued because of the cost of prosecuting and protecting against thieves like him. He is being sued to recoup the costs of the security, training, and the price of the item among other things. If he decides to fight it, he can be summoned to court and have to pay ATTORNEY FEES as well for the cost of the trial.

Georgia Code - Torts - Title 51, Section 51-10-6 - Georgia Attorney Resources - Georgia Laws

It allows Wal-Mart to "recover liquidated exemplary damages equal to $150.00 or twice the amount of the entire loss sustained by the property owner as a result of the willful damage or theft offense, whichever is greater, and the cost of maintaining the civil action if all of the following apply"

Sounds like your "friend" stole something worth $212.50
