What is the name of your state? tEXAS

My husband pays child support on his son that is 18 years old and is clasified as a freshman in high school. I was told by someone that his son must carry a C average in order for him to continue paying the c/s well make along story short he makes all f's in school, it seems like he don't want to try. What can we do?

Well, then. At this rate, he should be 35 by the time he graduates. Excellent upbringing! I guess intelligence ISN'T passed down from generation to generation! It certainly doesn't in your husband's genes. I hope you're gauging your own children's progress, because if this kid is any example, then you're in for it!

Have you ever heard him say, "Duh, which way did he go, George? Which way did he go?"

Most Texas child support lasts until a child graduates HS or he turns nineteen, which ever comes first.

TX CS goes on until the child turns 18 OR has graduated high school, whichever occurs LATER. CS could go on forever in this case.

Lets not start bagging on the kid now. Okay he is 18 and classified as a freshman. Classified means he doesn't have enough credits to be a senior and should be in some type of continuation or adult school. How many adults do you know out there that never graduated high school?...there are a lot.

Anyway...I know in the state of California that child support can continue until the age of 23 as long as they are full time students in college or get married. Please remember they will always be your children, long after they are 18!

C'mon! After freshman, one has enough credits to be classified a sophmore, then sophmore year they acquire the credits to be classified a juior, then junior year they acquire the credits to be classified a senior. There are three years of classifications between freshman standing and senior standing. I'm not that bright, and I managed it in 3 1/2 years.

Other than a major accident, illness, developmental disability or kidnapping, the only other reason that an 18 year old would still be a FRESHMAN is that he just f****d around for years and didn't even try. And that the CP did little to nothing about it.

And actually, NO, other than folks I know who fled the ****'s or the Communists or some other major conflict, I DON'T know anyone who didn't, at minimum, complete HS.

(Footnote: Someone please explain why the name of the WW2 German forces that starts with N gets blanked out? If someone wanted to mention, reparation fund money or some other legitimate reference, do they simply write "N**is"?)

Sorry I didn't mean to ruffle your feathers. I just was trying to be fair to someone neither one of us know.

But about not knowing anyone who hasn't completed H.S....well there are a lot of older military men that joined the military without a H.S. diploma or a G.E.D. It wasn't required back then. But thats not the point. Sorry to disappoint you!

Don't want to argue..just trying to be fair.

Oh wait...sorry you do know him...Its your post! Well hopefully your husband can get the child support stopped then if he isn't willing to try!

There is also court school too!

It is not her post, the posters name is New Wife. You are incorrect about child support in CA. The cut off is 19 even if they are still in High School, and has no bearing on the poster anyway.

Well for starters..sorry Next Wife...I got you confused with NewWife03.

As for I AM ALWAYS LIABABLE, I stated CAN continue until the age of 23!!!!!!!!!!! I didn't state WILL continue!!! Its up to both parents to continue the support. But you are entitled to your freedom of speech by calling names. No harm done here.

Sorry I wasn't clear on that. I wasn't quoting any laws, I was just going by experience. I collect child support in the state of California where my ex husband has to pay child support until the age of 23 as long as they continue to stay in college full time.

This is what you said. Child Support could continue forever if that is what a parent WANT'S to do. Where did you even get the age 23? Where did you get if they get married? :rolleyes:

If your X is still paying support, KUDO"S for having a great X, but the X cannot be under orders to do so. Child support must be paid until the child becomes 18, unless the child has not graduated from high school, in which case the child support continues until the child has graduated high school or becomes 19, which ever occurs first. Presently, the law does not give judges the power to make a parent support a child beyond the age of 19, unless the child is physically or mentally disabled. However, the parents can agree that child support is to continue into the college years,
and such an agreement will be ENFORCED by the Family Law Court.



Does it matter anyway's? The poster is not from CA.

You really are a dumb broad. What a bullsh!t retort. What the hell does "CAN" have to do with "LAW"? Jesus Christ, lady, anybody "CAN" do anything they want - - as long as it's legal. Child support ends, BY LAW, when a child graduates high school, and in NO EVENT after the age of 19. THAT'S THE LAW IN CALIFORNIA and THAT'S what were talking about - - "LAW". Hell, I can't help it if YOU and YOUR EX-HUSBAND have an "agreement" to extend support to some other age. For that matter, you can make an agreementto pay child support until your child is 58 years of age - - if you wanted to!!

MY RESPONSE: We're thrilled to death for you. But, he doesn't "have to" - - he voluntarily CHOSE to enter into that agreement. Therefore, for some reason, he WANTS to. No one held a gun to his head when he agreed to that. But, what's important is that the LAW didn't tell him to do that.
