What is the name of your state?New Jersey - When does child suport end? is it at 23yrs old - what if the kid goes to medical school, does the child support continue until they are done (which could be age 30) or is there a cut off - i mean at 23 they are adults/. :confused:

In my situation (Ohio) it ends at age 18 unless the child is still in highschool then it will go to 19 and not beyond that. It didn't say on the divorce decree that it will go on until college. She would have to take us back to court if she feels she "needs" it longer. I went to CS office and asked.

state of New Jersey - we dont have a court order - my husband ex girlfrield just went to court and he pays child support - she is going to be 21 soon and she is in college - so i dont know when it ends. Also - does anyone know if her mom is supposed to send us the transcripts of her grades - i know she is supposed to attend full time and pass a certain amount of grades - the boy is an adult - and we have small children at home - i wanted to know at what point does the support end for this adult.

So was a support order established?

State of New jErsey - yes - my husb has been paying child suport regularly since infancy for this child - the child will be actually 22 next year - and received regular payments - but are we to get proof of passing grades and college attendee (he also helps pay for college) - i just want to know at what age the support ends so that we can then apply that amount to help support our other children at home since they are very small and the child in question is an adult.

It should state in the order. If not, then check the state statutes. As far as grades, etc, that is a separate issue and the other parent is required to have access to those records (unless there was a court order specifying otherwise).

nj standard CS order so not state anything about when they expire.

You need to read your Judgement of Divorce or court order carefully to ascertain if there is an explicit age, or circumstance that determines the emancipation of the child(ren). If not, please note that there is no automatic age of emancipation as per New Jersey State Law, however, we use the following guidelines to assess if both parties agree to a voluntary termination of support and enforcement by Probation.

· The stipulated child has reached the age of 18 and is not attending school full-time;
· The stipulated child enters into marriage;
· The stipulated child has moved away (note: attending boarding school, camp or college shall not be deemed residence away from home and are not emancipatable unless stipulated in the Judgement of Divorce or court order);
· The stipulated child enters into the armed forces;
· The stipulated child has obtained full time employment after 18 years of age (not part time or full time during summer vacation and/or school breaks)

The existence of one or more of the above does not stop the enforcement of the order until a modified order is entered.

yep i just researched it but thats assuming the child is enrolled in school full time until then. it said NJ has the strictest CS laws, i knew i loved this state for a reason (NOT).

anyway to the OP if you are not getting proof of full time enrollement file for an emancipation ASAP! it takes about 3-4 months for an emancipation to go through and you must pay until it does.
