What is the name of your state (only U.S. law)? Illinois

My friend is mixed up with a cry wolf kind of guy. He cries his exwife is in contempt of their court order every week, for this or that. I got fed up and told him that it is only contempt if a judge says so, which means, getting off of his cry baby butt and filing a contempt of court hearing. He, out of the half million alleged contempt of courts she has committed (all very petty), never has filed for one single hearing. She may be in contempt on paper but a judge has to have the final say. He says she is and he has every right to keep the kids and the cops would side with him. Am I right?

Until a judge says she's in contempt?

She's NOT in contempt.

(And really - the cops aren't going to side with him. They're going to tell his crybaby whiny sniveling "poor me" butt to get back to family court)

And dear lawdy, tell your friend to be careful here - this is only a sign of things to come!

Thank you!!!! He called me a you know what from you know where when I said it and said he was going to beat me. I told him to go ahead but don't let it interfere with his cartoons! He is a joke and I tell my friend to get rid of him. They actual have one of those open relationships and he told her since they weren't "together" and he requires a boyfriend and a girlfriend...they will be together until he finds a suitable replacement. She was mortified and he said it in front of her kids who told their dad and...one can tell where this is going.

I will never choose a man over my kid. I tell her all the time that there are bigger and much better looking fish in the sea. I wonder how long til Dad of the Year figures out I've been the one slipping the speed dating fliers under their door!!!

Of course, one must wonder why it is YOUR business at all. Did he ask your advice?

I am just wondering. He asks me what to do, I tell him to call his lawyer. When he was screaming about her being in contempt, I got tired of it and told him that she wasn't until a judge said so. I just want confirmation I am right because my friend called and he was going on in the background about how stupid I was and he talked to a cop and the cop said I was wrong.

As was already said, you are the one who is right...and he sounds on the verge of getting himself into serious hot water.

Is she aware that he is not going to change for her? Please tell her that if she plans to continue to stay with this freak to use double, no triple protection EVERY time:eek:

Absolutely true.

Don't be so sure. Even though the police aren't SUPPOSED to get involved in civil disputes over custody, I've had more than my share of vigilante "white knight" cops who have come here to save the "poor damsel who is being denied her child by the evil wretched man". Cops go over the line, it happens, and even though they would be completely wrong to get involved they might anyway.
