My stb ex moved out 01/21/07. We have established custody and visitation for our 2 children thru a mediator (we have joint legal, and I am the residential parent).
Since he has left he has not given me a dime for the children. He has purchased them toys, clothes, snow boots and such, but he always keeps these things with him at his apartment. When I send the children to my stb ex's home, they always return in exactly what they were wearing when they left my house. He even asked for a dress back that my daughter was wearing!
Anyway, since our split there were (are) some things that I have been trying to get in order, most of which require some level of cooperation from him. Since I know he can be a very volatile person I haven't asked him for any support YET b/c I know that is only going to make him mad and less likely to be cooperative in the other things I need to handle.
So I have 3 questions.
1. Could my waiting to ask for child support have any negative repercussions when and if we go to court for support issues or even for our divorce?
2. When support is established will it be retroactive back to the date I first request it of him, the filing date, or will it be retroactive from the date he left?
3. Will he have any financial obligation for my 1st child (who is not biologically his - father deceased)? He knew of this child from the moment we met, and through our entire courtship, engagement, and marriage. My stb ex was in my son's life from the time he was 5 until our recent split (my son is 12 now). He did not legally adopt my son. He has shown no interest in continuing a relationship with my son and no custody/visitaion was addressed for this child.
