When someone has been incarcerated for 20 years and you have a case of unjust incarceration, when does the statutes of limitations begin? Before being released or after?

It begins when a court determines that the "someone" was falsely imprisoned.

Timing question misunderstood

I understand that a court determines that the "someone" was UNJUSTLY (not falsely) incarcerated, but is there statute of limitations to FILE such a claim? The State stated that such a claim was barred by the doctrine of res judicata. So do I file charges of wrongful conviction now while incarcerated or after released? If the answer is unknown please don't leave a sarcastic comment. If my metaphores are somewhat mixed up, so is our criminal justice systems, let's talk about getting the wrongfully incarcerated released.
