What is the name of your state? Ohio

My county does not have forms on their website. My ex and I would like to change the responsibility of health insurance coverage from him to me as I have better coverage. We've never been back to court since our divorce so I don't even know where to start. Also, our attorney for the divorce is now a magistrate, so I can't contact her either. Can someone help me find what forms I need to file for this modification. As I stated, it will be uncontested.

Ohiogal is a family law attorney in... should I be so obvious... Ohio, so she'll probably post definitively at some point, but I know that in NJ, the pro se packet is the same through out the state, and we just go to the state website to get the forms...

I would think, based on what I know in NJ, that it will be simple, especially since you both agree... it's just a consent form signed by each of you and filed with the court so that a judge signs it, stating that you will cover xxx children's health insurance due to better coverage... make sure the agreement includes any financial stuff you want to include... in NJ, generally dad provides the insurance and mom pays the first $250 out of pocket, so something like that might want to be adjusted since dad is not paying for the insurance... but like I said, Ohiogal will be around at some point.

I'm not worried about finacial specifics.....believe it or not my ex and I get along great and split everything 50/50 and if for some reason he can't afford it, my husband and I just pay it. We don't keep track. But I need a court order stating I'm responsible to have coverage before my insurance company (or should I say my husband's) will cover them.

Try your state government website rather than your county one. The forms may be available there.

However, if you are both in agreement, you don't necessarily have to involve the courts in this decision unless it is necessary to modify child support to take this change into consideration.....assuming that health insurance was part of your child support calculation.

We don't need to adjust the child support because we aren't following the guidelines anyhow. When we divorced, I didn't want child support because I wanted him to be able to support himself and the girls when they were with him. I was making more than him anyways, so the judge agreed to $50 a pay. I'm fine with that still. I've just been getting bills for things his insurance won't cover for the girls now that they are getting older and my husband's will. Also, my ex isn't able to get a medical spending account and we have one, but I can't use it on my girls if they aren't under our insurance.

It is NEVER a good idea to not legally modify a court order. NEVER.

Fairisfair, may I suggest and correct me if im worng that the OP may and Her EX have a written or typed agreement, signed and notorized to be filed with the court? That could be one option.

OG is the best to answer her questions.

But I see no reason why she and her ex cannot compose and file a simple joint petition to modify and file it with the court. The judge should have no reason not to sign off on it.

Steal a form from drcourt.org/forms
It is the Summit County Website but they have forms for everything. Just change the county at the top to your county. Use it as a template.

This is a little different though. Mom is free to enroll the kids in her insurance as secondary insurance anyway. Which actually might be a better idea than completely changing insurance. That way on the offchance that something goes wrong with her husband's employment (I think she said it was her husband that would be covering them) or dad's employment, the kids would still be covered.

It might seem different in that aspect. However, if mom was to suddenly change her mind and decide to suddenly enforce the order, or drop the coverage, dad would be responsible without the modification. It is never a good idea to ignore a court order in favor of whatever you decide, not even if you Both decide it. They need to modify the order.

Very valid point. It just seems a no brainer to me to both cover the child if coverage is available and affordable. It saves everybody money when there is secondary coverage.

I know your answer would be never say never because I see the people on here that make agreements without a court order and then end up regretting it later. But as much as I think my ex husband is an idiot at times, my children still love him and I would never do anything to hurt their father. My husband has been on the nasty side of divorce and I lucked out and don't have to be. (We've been divorced 9 years and haven't been back to court since).
