Which way is legally binding?

What is the name of your state? Colorado

I need to know which way is the better route to go. Me and my Ex are trying to stay out of court, and were wondering the best way to go to resolve some issues that we are having in regards to our current CO. In our CO currently there is nothing being said as to what dispute resolution we should do in case of disagreement, nor does it say who has the final say. He would like to do Arbitration as I would like to do Mediation. Which one is legally binding if a decision is made? Which is better? Do we both have to retain lawyers to do this as well?

You can hire a private mediator and split the cost. The mediator will help you two come to agreements on custody related issues. You can then file paperwork in court which reflects the things you both came to agreements on.
