I live in Delaware and my ex wife lives in Pennsylvania.
Our son lives at a Residential Facility for the Developmentally Disabled in Pennsylvania. My ex wife and I have joint legal custody that was settled in Pennsylvania.
My son is 20 yrs old and Mentally Retarded. Since his 9th birthday he has been living full time at a Residential Facility in Pennsylvania. His mother and I divorced 7 years ago.
I just learned that she had applied for and has been receiving our son's Social Security payments ($350 p/month)for the past two years. I thought he was not eligable till his 21st birthday when he would no longer be at his present residential facility. She did not notify me that she was getting this money till 6/4/01.
The school district where she lives pays all costs for his residential facility. None of his benefit payments go to the school. She claims she has been spending all the money on cloths and other expenses when he is home with her. We alternate visitations --every other weekend and we alternate holidays--he does not live with either one of us full time.
I just want to know how I can get an accounting of where this money is going and to make sure it is all going to my son. She remarried and has another child. I just can't imagine that my son is getting the benefit of over $4,000 per year since he does not live with her full time.
Is there any check and balance system in regards to this?
