Happy holidays everyone.

I'm a Plaintiff in a lawsuit against a big corporation in a David v. Goliath type of case represented by biglaw. Parties were ordered to mediation on December 5th and then that became a holiday so it was rescheduled for Jan. 23rd. Court ordered the parties to attempt settlment prior to mediation but opposing counsel was bascially ignoring me. So I emailed them and told them I would be filing for sanctions and possible contempt and to get one attorney removed because I caught her misrepresenting facts; she basically changed the defense that they had previously used in motion to dismiss. I also explained to them they had violated rules of professional conduct, etc. I was as nice as I could be about it. Yesterday, I got a letter yesterday saying that have withdrawn from the case. This is a fairly large firm.

Defendant is delaying the case as much as they can, they know it, I know it and it is hard to prove but I want to try. But who gets sanctioned in the event of withdrawal? I thought that the costs were shared between Defendant and counsel?

The new representation is a large firm but much smaller than previous firm so it appears they were downgraded.

Thank you.

Posting history. That is a complicated question actually. Because it depends on who is sanctioned and what the sanction is.
Px Hx is a must considering OP outlook on Attorney's and how great she is at winning lawsuits pro se. Also her views on many of the members of this site. It's worth a read.

Yes it is complicated. I'm not sure how two lawyers can get sanctioned if they have withdrawn. Do lawyers withdraw just to avoid being sanctioned?

Please link me to where I said that because I've never won a lawsuit. Also I don't have a sour outlook on all lawyers just like you likely don't have a sour outlook on all pro ses or do you?

I tell you that I like attorneys so much that I'm shopping for one. The case has become too complex and when I'm dealing with what I can only describe as dirty lawyer tactics, it wears me down too much. I'm too emotionally tied the case and when I'm to the point that I think I might need counseling for anger management, then its time to pull away.

I sort of figured you did. ;)

I hope you find the information in the links helpful.

I did. Thank you and I almost forgot to tell you that I exchanged some emails with Richard "Dick" Posner. He told me that he could help me find an attorney or help me win pro se lol.

Thought you might find that interesting. He might end up regretting making his email so publically available, bless him. Have a great day!
