What is the name of your state?NEW YORK

I HAVE BEEN WITH MY COMPANY OVER A YEAR AND JUST A MONTH AGO MY EMPLOYER STARTED TAKING OUT 5% OF PAY TO GO TOWARD WORKERS COMPENSATION. THIS APPEARS ON MY PAY STUB AS W/C.
MY QUESTION IS, IS THIS LEGAL THAT HE IS CHARGING EACH EMPLOYEE 5% OF THEIR PAYCHECK EVERY TWO WEEKS?

Unless NY WC reg's are very unusual as compared to other States, your employer is obligated to pay 100% of the premium for worker's compensation insurance. I suggest you contact NY's Department of Labor or Worker's Compensation Division and ask whether this deduction is lawful.

While I honestly don't know if it is legal or not in NY, I agree that it most states it is not and I'm not even going to guess at the answer, I will say that if it is legal in any state, NY would be on my list of possibilities. Since NY is one of the extremely few states where it is mandatory for an employer to provide disability insurance, it's not TOO big a stretch to imagine that it might be the sole state to allow an employer to charge the employee for a portion of workers comp coverage. Sauce for the goose, after all.

But I'm only throwing ideas around. I'm NOT telling you that it either is or is not legal.
