What is the name of your state (only U.S. law)? WV. I am taking my ex-tenants to court for unpaid utility bills. They claim they don't owe them because they were left in my name. Our rental agreement even says, "The utilities are the responsibility of the renters regardless of whether they're in their name or not." Why didn't you take action when the first utility bill was not paid DURING the tenancy? You may have set a precedent if you allowed them to live there the entire time never once collecting or acting on that clause. Why did you not have the utilties changed over to the tenant's name? Do you also live there?
