Florida, 3 years ago, my daughter moved in with her father and a change of custody agreement was enacted making him the custodial parent through a shared parental agreement. He lives in Miami, I resideded in Ft. Lauderdale. This past year I requested a reduction in child support because of loss of income, loss of job, loss of house, you name it. Here's where it goes sideways....

He moved his family to Cape Coral (including our daughter). The step-mother and my daughter now reside in Cape Coral, FL, while the custodial father lives at his mothers house in Miami where he works. He works there 3 - 4 days a week and also frequently flies out of town both Nationally and Internationally as he's an FAA Inspector for an Airlines.

My question is this: Is there a certain amount of hours that the custodial parent must reside with the minor child in the same household? He's telling the courts that his legal residence is Cape Coral, it's on his driver's license. But that's NOT where he lays his head the majority of the nights. It's in Miami and internationally too.

What bearing does this have on child support and how much I'm paying, do I still have to pay the same amount, because he's not a "Full-Time" custodial parent now. The way I see it, He's not taking care of our child, a non-custodial parent is.

Tough Question huh???? HELP!!!!What is the name of your state? What is the name of your state?

Child support is not based on what parent is living where.

That is why it is called CHILD support; it is for the support of the child.

Simple....
