The fact is, the only issues that can be amended or modified as a result of a divorce proceeding are those of alimony, child support, visitation and post-majority expenses.

If the supplying of the tax form was part of a parenting plan or other of the above, then it can be modified. However, under illinois statute, if the issue is part and parcel of either the original divorce decree of property settlement, then no, it cannot be modified unless the original decree is found to be defective by reason of fraud or mistake of law.

Sorry. I was assuming it was part of a parenting plan. Wasn't trying to mislead. She mentioned the kids and when it was in relatiion to support, I figured it was a part of the modifiable. Gotta quit inserting facts that aren't there. BB is right though.

Bottom line is this is the issue: Ex is a nutcase, my bf and I are fed up with her threats and you all know because I have posted them up here. She's always lookin for something to complain about. Basically all her threats are just that. Thanks to all of you, I (we) have realized that and it's very comforting. I just wanted to know if that part of the agreement w/ the taxes could be changed. Obviously he's an idiot for agreeing to that. She's constantly calling saying once I get your taxes I'm taking you back to court for more money. Thanks to you guys we know she can't do that. His income has not changed and there has been no change in circumstance. His daughter will actually be living a "better" lifestyle with her new step dad since he makes more money. Which is fine! Great! We just want to abide by the law and do what's right for the child. It's difficult to do that when the mother doesn't see things that way. On many occasions she has made it a point to state that she is our sworn enemy and every penny he gets will go to her (not the child) and that she will do everything she can do ruin our lives. So yes it is frustrating. I just come here to make sure we are doing the right thing. And all of her threats are recorded considering she emails this crap to him, so in the event anything goes to court we have that to present. Her newest thing now is she spoke to her attny and her attny states it's a proven fact that my bf had to pay CS through the childs college education to the mother. I mean PLEASE! Give me a break! So yes, I come here for advice to ease our minds on this ridiculous jargon.
